I. INTRODUCTION

This matter is before the Court on Defendant’s Motion for a Judgment as a Mat ter of Law or, alternatively, a New Trial (“JMOL Motion”) (Docket # 191). Plaintiff has filed a response, 2 to which Defendant replied. 3 The Court finds that the facts and legal arguments pertinent to the JMOL Motion are adequately presented in the parties’ papers, and the decision process will not be aided by oral arguments.
