Appeal from Special Term, New York County. In the matter of the application of the city of New York to acquire lands for opening noth street. From an order confirming the report of the commissioners and awarding damages to Philip Dietrich, J. Sergeant Cram and another, as trustees under the will of Henry A. Cram, deceased, appeal.

The regularity of the proceedings in this matter is not questioned, nor is the city interested. The point involved is *33the validity of the award made to Philip Dietrich for the value of a leasehold interest in certain premises affected by the widening of noth street. Henry A. Cram was the owner of the premises involved during his lifetime. He died, leaving a last will and testament, which was duly admitted to probate in the county of New York on the 1st day of May, 1894.
