Affirming.

The appellant and defendant below, B. W. Black, at the time of the occurrences herein involved, was a duly elected qualified and acting justice of the peace in Boyd county. The grand jury therein returned an indictment against him wherein he was accused of misfeasance in office. Its sufficiency is not questioned, nor do we detect any defect in it. At his trial, after entering a plea of not guilty, he was convicted and punished by a fine of $100.
