The appellant was indicted in the court below for selling liquor to a minor, the indictment charging that the defendant did “unlawfully barter and sell to one William Wood a certain intoxicating, spirituous and malt liquor, in a less quantity than a quart at a time, to wit, one half-pint of' spirituous and malt intoxicating liquor, at and for the price' of ten cents,” with an averment of tho minority of Wood.

On trial the defendant was convicted, and a motion made-*369by Mm for a new trial was overruled. The evidence on the subject of the sale was as follows :
