The appellant and another were jointly indicted for a violation of section 2094, R. S. 1881. A motion to quash was overruled. The appellant was tried separately, by the court, without the intervention of a jury, and found guilty and fined in the sum of $25. A motion for a new trial was overruled, and judgment rendered on the finding.
The first error assigned calls in question the decision of the court in overruling the motion to quash.
