Nuss, J.:

Paul Drayton directly appeals his convictions of first-degree murder and felony theft. Our jurisdiction is under K.S.A. 22~3601(b)(l), conviction of an off-grid crime.

The issues on appeal, and this court’s accompanying holdings, are as follows:
