Although this case has been elaborately argued by counsel, it would seem it ought not to require any very extended discussion, as the controlling facts occurred in a single day, and are comprised in a brief compass. The action was commenced by Mark Carley, against Samuel H. Larminie and Edward A; Bigelow. Afterwards, it was discontinued as to the latter-named defendant. The declaration contains only the common counts, to which the general issue was pleaded.
