By the Court, Crockett, J.:

This is an appeal on the judgment roll alone, by the plaintiff in ejectment, from a judgment in favor of the defendant. It appears from the findings that an action was commenced in a Justice’s Court against one Isidora Briones, a married woman, to recover a sum of money alleged to be due on a contract, which it now appears was made during the marriage ; that the said Isidora was duly served with a summons in said cause, and filed an answer therein, setting up her coverture as a defense to the action.
