Before the court is a motion brought by the debtor seeking to reclassify, as general unsecured claims, not subject to priority, the interest and penalty portions of priority tax claims heretofore filed by the federal and state taxing authorities. For the reasons stated below, the court holds that: (1) penalties and interest on post-petition taxes are afforded priority status as administrative expenses along with the underlying debt; and (2) interest on pre-petition taxes is entitled to priority status, but pre-petition penalties are…
