ATKINS, District Judge.

This cause came before the Court for a non-jury trial upon Plaintiff’s complaint and Defendant’s counterclaim, both seeking a determination as to the validity, under the Sherman Antitrust Act, of a covenant not to compete in an employment agreement entered into between the Defendant and the Plaintiff. Plaintiff seeks a declaratory judgment that the provision is invalid and unenforceable and an injunction against its enforcement.
