MEMORANDUM OPINION

Before the Court is the appeal of defendant, Cleopha Bennett (“Bennett”), from an order entered by the Magistrate Judge on September *98017,2007, denying Bennett’s motion for reconsideration. At the conclusion of the evidentiary hearing in this matter, the Court ruled in favor of Bennett. This memorandum opinion memorializes that ruling.
