This was a suit by defendant in error for ten thousand dollars brought in the Circuit Court of Saline county to the April term, 1911, against the Saline County Coal Company. Prcecipe for summons filed March 22, 1911. The cause was on May 13, 1911, continued generally. The declaration in the case was filed June 2,1911, against the Saline County Coal Company and plaintiff in error ad damnum two thousand dollars, this being in vacation after the April term, 1911.
