Henry Lutz instituted suit in 1919, in the Circuit Court of Buchanan County, against the beneficiaries in the will of his mother, to have a trustee appointed to receive the estate from the administrator and to declare the true intent and meaning of the will and direct and supervise the administration of the estate. Schneider, the trustee named in the will, was not a party to the suit. On the death of Henry Lutz, the cause was revived in the name of his administratrix.
