Appellant William Bagley filed two petitions in probate court against his sister, the executrix of their mother’s estate. One petition sought her removal as executrix; the other petition sought to have set aside a deed and conveyance of the decedent’s home from appellee as executrix to appellee individually. Both petitions were denied by the probate court and an appeal to the superior court followed.
