The material facts in this case are correctly stated by the Court of ■Civil Appeals, as follows :
“The appellee, Mrs. Minnie Johnson, as temporary administratrix, sued the appellant for damages resulting from the death of her husband, W. E. Johnson. The facts alleged and established upon the trial below show that Johnson was, at the time of his death, employed by the appellant in operating one of its freight trains.
