This suit was filed by Mrs. Birdie Steen, as the administratrix of the estate of her deceased husband, C. L. Steen, to recover damages resulting from his death. Steen.was killed in January, 1925, while in the service of the appellant as a switchman. He had been employed a day or two before as an extra man to work in the appellant’s yards at Texarkana. In those yards were a large number of railway tracks, which are crossed by two viadaets — one on the Texas side of the state line, and the other on the Arkansas side.
