OPINION OF THE COURT ON PLAINTIFF’S MOTION FOR A NEW TRIAL

HAYES, District Judge.

This action was tried at Salisbury, North Carolina, and a verdict in favor of the defendant was rendered by the jury on the 8th day of October,. 1969. The plaintiff filed a motion in writing for a new trial, which motion appears of record and which in part was directed to an alleged error in the Court’s charge to the jury, but the Court denied the motion and signed a judgment of dismissal on October 8, 1969.
