OPINION and ORDER

RUSSELL, District Judge.

This action in negligence was tried before me with a jury at Charleston. At the conclusion of the testimony, the defendant moved for a direction of verdict on the grounds (1) that there was no evidence of negligence on the part of the defendant and (2) that, if there was any such evidence, the plaintiff was barred from recovery as a matter of law by his own contributory negligence and recklessness.
