delivered the opinion of the court.

Plaintiff brought an action against defendant to recover damages for personal injuries claimed to have been sustained by him through the negligence of one of defendant’s employees in driving a garbage motor truck to which three trailers were attached.

May 22, 1934, there was a jury trial, and at the close of plaintiff’s evidence defendant’s motion for a directed verdict yas sustained and a ¡verdict rendered accordingly. June 2nd following plaintiff’s motion for a new trial was allowed and the following November there was another…
