In this direct criminal appeal, Deandre Fugate appeals from the final judgment entered in the District Court 1 for the Western District of Missouri after he pleaded guilty to possession with intent to distribute 100 kilograms or more of marijuana, in violation of 21 U.S.C. § 841(a)(1) and (b)(1)(B) and 18 U.S.C. § 2. After granting the government’s motion for a substantial-assistance departure, the district court sentenced Fugate to 46 months imprisonment and 4 years supervised release.
