I. INTRODUCTION

Plaintiff Bradley Brigham brought suit against Sun Life of Canada (“Sun Life”) after Sun Life terminated his long term disability benefits. In his three-count complaint, Brigham alleged violations of Mass.Gen.Laws ch. 93A, breach of contract, and violations of 29 U.S.C. §§ 1001 et. seq. (“ERISA”).
