POEEOCK, District Judge.

This is an action brought by the receiver of the Yates Center National Bank, an insolvent national banking. asspciation, to recover from defendant the amount of a promissory note made by him to the bank, October 7, 1913, for $2,500.

It is clear from the evidence produced on the trial there was no consideration whatever for the making of this note. On the contrary, defendant was induced to make it solely as an accommodation to the bank at the earnest solicitation of its president and general managing officer, C. G.
