Elsie M. Smith instituted in the Circuit Court of Upshur County this action of trespass on the case against Selma Haymond, Nora Duvall, Georgia Lane, Summers Hay-mond, Mark Haymond, Herman Haymond, and Anna Pyles, to recover damages in the amount of $15,000.00 for the alleged wrongful obstruction of a disputed easement for a right of way leading from a public road across the defendants’ lands to land owned by plaintiff. This writ of error is prosecuted to a judgment entered on October 7, 1949, sustaining a plea of res judicata to plaintiff’s declaration and dismissing the action,…
