¶44 I agree with the majority that Wisconsin Stat. § 767.43(3) infringes upon parents' fundamental liberty interest in the care, custody, and upbringing of their children and therefore must withstand strict scrutiny in order to be constitutional. Majority op., ¶2. I also agree that the circuit court's visitation order in this case violated the constitutional rights of the parents and I join the mandate vacating the circuit court's order.
