This was an action by appellees, Hollis Massey and Oscar Bunge, against appellants, American Water Company, a corporation, and against Howard P. Holmes and J. C. Crain, for failure to drill an irrigation well that would produce 2500 gallons of water a minute. Appellees also alleged negligence in drilling and equipping the well and also alleged fraud. Appellants Holmes and Crain were made defendants as being the purchasers of the business of appellant, American Water Company, and as having assumed all of its obligations.
