Appellant, Rogelio Moreno Denoso, was indicted on one count of intentionally and knowingly causing the death of David Cha-pa Quintero by shooting him with a fire arm. 1 Appellant entered a plea of not guilty. Tried to a jury, the charge included instructions on party and principal theories of criminal responsibility and on the affirmative defense of duress. The jury found appellant guilty of murder and assessed punishment at life imprisonment.

The trial court has certified that this case “is not a plea bargain case, and the defendant has the right of appeal.”…
