This is a social security appeal filed by Carl Dierks (“Dierks”) pursuant to 42 U.S.C. § 405(g) for judicial review of the final decision of the Commissioner of the Social Security Administration (“Commissioner”) denying Dierks’ claim for disability benefits under Title II because Dierks was not under a “disability,” as defined in the Social Security Act, 42 U.S.C. §§ 401, et seq.
