WEINSTEIN, Senior District Judge.

The events in this case arise out of a shooting that occurred in Brooklyn over twenty years ago. Athough the incident took place in 1982, petitioner Herman Turner was not indicted until 1999, when he was charged with second degree murder for the homicide. After a jury trial he was convicted of first degree manslaughter, a crime for which New York’s ten-year limitations period had already run.
