MEMORANDUM OPINION (Denying Defendant’s Motion to Dismiss the Indictment)

This matter is before the Court on Defendant’s Motion to Dismiss (Dk. No. 12), filed on March 23, 2010. In this Motion, the Defendant challenges the constitutionality of 18 U.S.C. § 922(g)(9), possession of a firearm by a person convicted of a misdemeanor crime of domestic violence, as applied to the indictment in this case.
