I. Introduction
On April 15, 2002, Marisol Cruz (“Cruz”) commenced this action on behalf of her infant son, Christopher Soto (“Plaintiff’), pursuant to Sections 205(g) and 1631(c)(3) of the Social Security Act, as amended, 42 U.S.C. §§ 405(g) and 1383(c)(3), seeking review of the denial by the Commissioner of Social Security (the “Commissioner”) of Plaintiffs application for Supplemental Security Income (“SSI”) disability benefits under Title XVI of the Social Security Act, 42 U.S.C. § 1381, et seq.
