Presently before the Court is a motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6), filed by the Defendant, U.S. Airways, Inc. (“US Airways”). For the reasons that follow, the motion will be granted.
Plaintiff, U.S. Airline Pilots Association (“USAPA”), brings this action seeking to vacate an arbitration award issued pursuant to the Railway Labor Act, 45 U.S.C. §§ 151-88 (“RLA”) on the grounds that the arbitrator ignored the clear and unambiguous language in the parties’ agreements and also on the…
