Defendant was charged by indictment with four counts of felony: (1) violation of Health and Safety Code, section 11500 (sale of heroin on January 30, 1958); (2) violation of same section (sale of heroin on January 31); (3) violation of same section (possession of narcotic on February 4); (4) violation of Health and Safety Code, section 11557 (maintenance of a place for sale and use of narcotics). Defendant admitted a prior conviction of violation of section 11500. Defendant’s motion under section 995, Penal Code, to dismiss the indictment was denied.
