*1371Appeal from an order of the Supreme Court, Erie County (Joseph R. Glownia, J.), entered February 27, 2004. The order denied the motion of third-party defendant for summary judgment dismissing the third-party complaint.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs, the motion is granted and the third-party complaint is dismissed.
