In the case of Doss v. State, 123 So. 231, decided by this court at the present term, which grew out of the same transaction as this one, the rulings of the circuit court and their treatment by the Court of Appeals relating to the formation of the grand jury, the sufficiency of the indictment, the construction of section 31S9 of the Code 1923 (the kidnapping statute), and the effect of the evidence as showing a violation of that statute, have been fully discussed, and the conclusion of this court stated. The views there expresssed have application here, and need no further discussion.
