This case involves a dispute over attorney fees. Plaintiff attorneys were engaged by defendant upon a contingent fee basis to contest the probate of her father’s will. 1 Plaintiffs were successful and on September 18, 1961, Judge Raymond Smith of the 20th circuit determined that defendant’s father lacked testamentary capacity when he executed his will thereupon entitling defendant, as sole heir, to the entire estate.
