On February 14, 1958, tbe defendant purchased a single residence house and lot on Oliver Street, in the City of Rochester, for the purpose of converting it to an eight-unit multiple dwelling. On March 6, 1958, he was advised by plaintiffs’ attorney by letter of the existence of restrictions against .such use of his property and was called upon to cease and desist from any violation thereof.
