OPINION
MINGE, Judge.
Appellant challenges the district court’s grant of summary judgment denying his claim against respondents 1 for discriminatory refusal to hire. Appellant asserts the district court erred in determining that (1) there was no genuine issue of material fact whether respondent’s justification for not hiring appellant was pretextual; and (2) relief for employment discrimination was barred by respondent’s discovery during litigation that appellant failed to disclose a criminal conviction on his employment application.
