FACTUAL AND PROCEDURAL BACKGROUND

The facts are not in dispute. 1 Anna Moran Kessler (Anna) and Joseph Kessler (Joseph) had been married for over twenty years. On July 11, 1995, they executed mutual and reciprocal wills in which they made provisions for the children from their earlier marriages. The wills acknowledged that Anna and Joseph had an oral agreement directing distribution of their separate and joint property when they died.
