This ease reached the Kansas City Court of Appeals on appeal from a judgment for defendants in the Circuit Court of Miller County. The Court of Appeals reversed the judgment, and remanded the case with directions to render judgment for plaintiffs. [Plemmons et al. v. Pemberton et al., 117 S. W. (2d) 392.] Thereafter this court, in a proceeding in certiorari brought by defendants, as relators, held that the case was within the exclusive appellate jurisdiction of this court because involving title to real estate within the meaning of the Constitution; and, accordingly, quashed the opinion and…
