BOWMAN, Circuit Judge.,

Russell Bradley Marks appeals from the judgment of the District Court denying his motion to compel specific performance of an agreement that, according to Marks, requires the government to move for a reduction of the sentence he is currently serving for drug-related activity. We af firm, but for a reason different from that given by the District Court.
