Judgment, Supreme Court, Bronx County (Goldfluss, J.), rendered on January 11,1981, convicting defendant upon a jury verdict of robbery in the second degree, and resentencing him on March 19, 1981, as a second felony offender to a term of 6V2 to 13 years, reversed, on the law, the facts and as a matter of discretion, in the interest of justice, and the matter remanded for a new trial. The defendant and a codefendant were indicted in a supermarket robbery. The robbers were pursued by the police and fired at the officers who returned the fire.
