This action arises out of the decisions of the Westport Community School Committee (the “Committee”) to discontinue the employment of plaintiff Susan Dumais (“Dumais”) as a school teacher. Plaintiff filed this complaint on May 25, 1993, for declaratory judgment (Counts I, II and III), breach of contract (Count IV and Count V), negligence (Count VI), and civil rights violations (Count VII). Plaintiff now moves for summary judgment on Counts I, II and III. Defendants cross moved for summary judgment on all counts, claiming that the action is time-barred.
