Immacula Antenor and 610 other seasonal agricultural workers (“farmworkers” or “pickers”) appeal from a summary judgment in favor of D & S Farms and Iori Farms, Inc. (“growers”) on their claims under the Migrant and Seasonal Agricultural Worker Protection Act and the Fair Labor Standards Act. 1 The district court granted the judgment after concluding that the farmworkers presented insufficient evidence that they were “employed” by the growers under these statutes.
