OPINION AND ORDER ON MODIFICATION OF PLAN AFTER CONFIRMATION

Debtors filed their Chapter 13 case on August 29, 2009. Now before the Court is the Chapter 13 Trustee’s (the “Trustee”) Modification to Chapter 13 Plan After Confirmation Dckt. No. 71. The sole basis for the Trustee’s proposed modification is the Debtor’s post-confirmation receipt of an inheritance in the amount of $45,054.37, which the Trustee concedes is not “property of the estate” within the meaning of 11 U.S.C. §§ 1306(a) and 541 (because the decedent died more than 180 days…
