FORMAN, District Judge.
Plaintiffs instituted this action under the Federal Declaratory Judgment Act (Jud.Code § 274d, 28 U.S-C.A. § 400) for the purpose of procuring a determination of their rights under a certain policy of insurance issued by them in which Mercer Tuberculosis Sanitorium is the named insured. The defendant Margaret L. Johnston trades as the Mercer Tuberculosis Sanitorium. The policy was issued by the plaintiffs on July 30, 1935, in which they agreed to pay on behalf of the insured named therein all sums of money which the insured should become obligated to pay by reason of…
