Plaintiff has been a member of the police department of the City of Saginaw for over 20 years. Defendant police and fire department civil service commission is a body established pursuant to CL 1948, § 38.501 et seq., as amended (Stat Ann 1958 Rev § 5.3351 et seq.).

Promotions in the department are covered by CL 1948, § 38.501, et seq., and the rules and regulations of the civil service commission under that act. The commission conducts competitive examinations from among persons with at least five years in the department and at least two years in the next lower rank in order to establish an…
