This was an action on the case in the City Court of East St. Louis, by appellee against appellant, to recover for a personal injury resulting in the death of appellee’s intestate. Verdict and judgment in favor of appellee for $5,000.
At the close of all the evidence, appellant’s counsel moved court to exclude all the evidence and direct the jury to return a verdict in favor of appellant. The court denied the motion and counsel strenuously insist here that this action of the trial court is manifest error.
