This case comes to us for the second time. Our first opinion can be found at 41 F.3d 1124 (7th Cir.1994). We assume familiarity with the contents of that opinion and will address only the facts and legal issues that are relevant to the much narrower questions now before us. The fundamental question before the district court, after our reversal of its initial summary judgment award to Eileen Mlsna, was whether Theodore Mlsna (“Mlsna”) was terminated for “gross misconduct” under the Consolidated Omnibus Budget Reconciliation Act of 1986 (“COBRA”), 29 U.S.C. §§ 1161-69, thus…
