The appellant filed suit against Smith Barney, Harris Upham & Co., Inc. alleging that the brokerage firm and its employee, Bruce Brookshire, failed to disclose to him risks inherent in options trading. He further alleged that Smith Barney churned his account in violation of sec. 10(b) of the sec. 78j(b), Rule 10b-5, 17 C.F.R. sec. 240.-10b-5, and state common law. The district court granted Smith Barney’s motion to dismiss the appellant’s churning claim at the close of the appellant’s case.
