By this appeal plaintiff seeks to reverse a judgment of the circuit court of Cook county dismissing his suit at his costs on the ground that the original declaration did not state a cause of action and that the cause of action stated in plaintiff’s amended declaration was barred because more than one year had elapsed since the death of the deceased.
